Trust Deed

This indenture made and entered into this 10th day of April, 1905 by and between Richard F. Wright and Martha Wright his wife of the County of Little River and in the State of Arkansas as party of the first part and G. A. Spaulding of Garvin d.t. as Trustee party of the second part and F. D. Taaffe and J. W. Kirk as parties of the third part. Witnesseth that the parties hereto of the first part for the consideration hereafter stated and of the sum of One Dollar to them in hand paid the receipt of which is hereby acknowledged paid to them by the party of the second part have granted, bargained and sold and by these presents do grant bargain and sell to the party hereto f the second part to their successors and assigns forever the property hereinafter described, situated in Little River County in the state of Arkansas to wit:

NW 1/4 of NW 4 Sec 8. - NW 4 NE 4 Sec 4 Township 12 S. Range 30 West and West 2 NW 4 Sec 8 and NW 4 SW 4 and S1/2 SW 4 and S E 4 of Sec 4 and N 1/2 NE 4 Section 9 in Township 12 S Range 31 West.

To Have and to Hold the above described premises, together with the tenements and hereditaments and appurtenances, rights and privileges unto and profits and incomes thereon. Belonging or anywise appertaining thereto, to the party hereto of the second part, and to his or her successors and assigns forever, and the parties hereto of the first part hereby covenant with the party hereto of the second part to his successors and assigns that they are seized in fee of the said premises and have the right to convey the same: That the said premises are free from all incumbrances and will warrant and defend the same to the party hereto of the second part, his successors and assigns in the quiet and peaceable possession of the same against the lawful claims and demands of any person or persons whoever they may be and the parties hereto of the first part hereby expressly release and convey all rights of dower or homestead in and to the said premises.


But this conveyance is made in trust for the following purposes only. That is to say that whereas, the parties hereto of the first part are indebted to the party of the third part in the sum of One Thousand Dollars for that amount upon bond of R.J. Wright secured bond for appearance of said R. J. Wright before U.S. Court at Antlers d.t. Sept 4, 1905 by the parties of the third part for the parties hereto of the first part, which is evidenced by of date April 8, 1905 and becoming due and payable as follows, to wit: Setp 4, 1905 upon default of appearance of said R. J. Wright at said date to answer the charge of manslaughter.

Now if the said bond be paid when due and all agreements are faithfully kept and fulfilled and said R. J. Wright shall appear as aforesaid then these presents shall be void and the property released in all things at the expense of the party of the first part: but if default be made in the payment or appearance of said R. J. Wright on Sept 4th 1905, or in the payment of any of the taxes that may be charged theron or in any insurance premiums that may be necessary then the whole of said indebtedness may become immediately due and payable without notice to the parties, hereto of the first part then this deed shall remain in full force and effect. And the party hereto of the second part or such person as may be apointed in his place as hereinafter mentioned may at the request of the holder of said bond proceed to sell the property hereinbefore described and any and every part thereof and all right and equity of redemtpion therein of the parties hereto of the first part their heirs or assigns at public vendue to the highest and best bidder at the front door of the United States Post Office in the town of Foreman Arkansas by first giving 20 days notice of the sale the time, terms and place of the sale and of the property to be sold by an advertisement in some newspaper published in the county in which the land is located and upon such sale the trustee shall execute and deliver a deed of conveyance to the property sold to the purchaser or purchasers thereof and any statement or recital of fact in such deed in relation to the non-payment of the money ________y secured to be paid _____istence of the indebted ________so seaired (sic) notice by the advertisement of notices of the sale the receipt of the money and the appointment of another trustee whereby such other trustee may have become successor as herein provided shall be prima facie evidence of the truth of such statement or recital and the said trustee shall receive the proceeds of said sale out of which he shall pay first the cost and expenses of executing this trust and next to the parties of the first part such money as he has paid out for taxes and next to the parties hereto of the third part the full amount of said bond with secured interest thereon and next if any to the parties hereto of the third part or their legal representatives.

In case of refusal neglect or incompetency (sic) to ask of the said trustee or his absence or his decease, then the parties hereto of the third part or their legal representatives can at the time they may desire, appoint a trustee in the place of the party hereto of the second part or any succeeding trustee, whose acts done in the premises shall have the same validity as if done by the trustee hereinbefore named, but he shall have no power to execute a release of this deed of trust. In testimony whereof the said parties of the first part have hereunto set their hands and seals the day and year above written.

This day personally appeared before me the undersigned, a duly commissioned, qualified and acting Notary Public within and for said county and state, the within named Richard F. Wright and Martha Wright to me personally known to be the grantors of the foregoing deed of Trust and acknowledge that they signed, executed and delivered the same on the day and year therein mentioned for the uses, purposes and consideration therein mentioned. And I further certify that on the same day voluntarily appeared before me Martha Wright wife of the said Richard F. Wright also personally known to me to be one of the grantors in the foregoing Deed of Trust and being by me examined seperately and apart and in the absence of her said husband after I had fully explained its content purport and legal effect, declared that she had of her own free will executed the same and relinquished all right of dower and of homestead in said premises for the purposes and consideration therein contained and set forth without compulsion or undue influence of her husband.
