WITH LIEN AND RELINQUISHMENT OF DOWER

 

Know All Men By These Presents:

That we, W. H. Beauchamp, and Annie Maude Beauchamp his wife

For an in consideration of the sum of $250.00 TWO HUNDRED DOLLARS, paid and to be paid by J.A. Millender and T. J. Millender as follows, to wit: Fifty Dollars ($50.00) dollars cash in hand (the receipt of which is hereby acknowledged), and One Hundred Fifty & No / 100, Dollars to be paid as follows, evidenced by three promissory notes of $50.00, each bearing 6% interest from date, payable as follows, to wit:

One note, dated 2/20/1934, for $50.00, due 12/20/1934,
One note, dated 2/20/1934, for $50.00, due 12/20/1935,
One note, dated 2/20/1934, for $50.00, due 12/20/1936.

Bearing interest from date until paid, at the rate of 6 per cent annum, do hereby grant, bargain and sell unto the said J. A. and T. J. Millender and unto their heirs and assigns forever, the following lands lying in the County of Little River and State of Arkansas, to wit:

The North East Quarter (N. E. ¼) of the Southwest Quarter (S. W. ¼) of Section Eight (8), Township Ten (10) South, Range Thirty Two (32) West, containing Forty (40) acres more or less

To have and to hold the same unto the said J. A. and T. J. Millender and unto their heirs and assigns forever, with all appurtenances thereunto belonging. Excepting, however, all Highway or Improvement District Taxes which may be due against this tract of land, and we hereby covenant with the said J. A. Millender & T. J. Millender that we will forever warrant and defend the title to said lands against all lawful claims whatever, and that said lands are free from all liens and incumbrances. It being herein expressly understood that a lien is hereby retained upon said lot or parcel of land to secure the payment of residue of the purchase money hereinbefore mentioned.

And I, Annie Maude Beauchamp wife of the said W. H. Beauchamp for and in consideration of the said sum of money, do hereby release and relinquish unto the said J. A. Millender and T. J. Millender all my rights of dower and homestead in and to the said lands.

Be it remembered, that on this day voluntarily appeared before me, a Notary Public, within and for the County aforesaid, duly commisioned and acting, Annie Maude Beauchamp, wife of W. H. Beauchamp, to me well known, and in the absence of her said husband, declared that she has of her own free will, executed said Deed and signed and sealed the relinquishment of dower and homestead in the said Deed for the consideration and purposes therein contained and set forth, without compulsion or undue influence of her husband.

Know All Men By These Presents:

That we, Mrs. J. A. Millender widow of J. A. Millender. T. J. Millender and wife Hazel Millender, and May Slaton formerly Millender and husband Earl Slaton being the sole heirs of J. A. Millender decesed

For an in consideration of the sum of ONE HUNDRED FIFTY NINE AND NO/100 DOLLARS, paid and to be paid by Rufus Kirk as follows, to wit:

FIFTY NINE AND NO/100 dollars cash in hand (the receipt of which is hereby acknowledged), and note for $100, due in one year with 6% interest and the Grantee is to pay $150. Due W. H. Beauchamp on laid land described in Deed dated Feby. 20 1934. This deed is made subject to (3) Three Vendors Lien Notes of $50.00, each, due W. H. Beauchamp, Horatio, Ark.,

Bearing interest from date until paid, at the rate of 6 per cent per annum, do hereby grant, bargain and sell unto the said Rufus Kirk and unto his heirs and assigns forever, the following lands lying in the County of Little River and State of Arkansas, to-wit:

Northeast Quarter of Southwest Quarter (NE ¼ of SW ¼ ) Section Eight (8), Township Ten (10) South, Range Thirty-two (32) West containing 40 acres more or less.

The Grantor T. J. Millender owns a half interest in the above lands and he conveys said half interest in his own name as well as his interest as one of the heirs of J. A. Millender in the other half interest.

To have and to hold the same unto the said Rufus Kirk and unto his heirs and assigns forever, with all appurtenances thereunto belonging. And we hereby covenant with the said Rufus Kirk that we will forever warrant and defend the title to said lands against all claims whatever, and that said lands are free from all liens and incumbrances. It being herein expressly understood that a lien is hereby retained upon said lot or parcel of land to secure the payment of residue of the purchase money hereinbefore mentioned.

And I, Hazel Millender wife of the said T. J. Millender for and in consideration of the said sum of money, do hereby release and relinquish unto the said Rufus Kirk all my rights of dower and homestead in and to the said lands.
